1.0 PURPOSE

To provide an appeal or informal grievance procedure for a fair resolution of complaints from students with documented disabilities who disagree with the provision of accommodations or who believe they have been subjected to discrimination based on their disability.

2.0 POLICY

2.1 Policy Statement

Disability Services strives to resolve complaints through an informal appeal process when possible. Students with concerns regarding their rights under Section 504 of the Rehabilitation Act of 1973 or the Americans with Disabilities Act and its Amendments should contact the Disability Services Director to follow the Informal Grievance Appeal Procedure.

2.3 Procedure

  1. Students with disabilities who wish to file a complaint will contact the Disability Services Director and submit a Disability Informal Grievance Form.
  2. The Director of Disability Services will conduct a confidential investigation consisting of a review of the documentation, discussion with the complainant, the Vice President of Academic Affairs (or an appropriate designee), and other relevant parties.
  3. A final decision will be rendered and the complainant will be notified in writing by the Vice President of Academic Affairs within fifteen business days of the date the appeal was submitted.
  4. If the outcome of the informal appeal is not satisfactory, students may file a Formal Grievance.

3.0 AUTHORIZATION  

The Director of Disability Services has the authority to change, modify, or approve exceptions to this policy at any time, with or without notice, in accordance with federal disability regulations or modifications and amendments to those regulations, with the approval of the Chief Academic Officer and the President of the University or his designee (Compliance Coordinator).
